Rules for 1st Annual Delaware Seafood Festival  

All displays must be set up during the designated set up times described in the show schedule. Any  vendor not setup in the allotted times will not be allowed to setup and will not receive a refund.  

Once your application has been reviewed and accepted no refunds will be given for any reason.  This is a rain or shine event.  

Vendors are contracted to be open for the entirety of the show. NO BREAKING DOWN EARLY UNLESS  GRANTED BY THE PROMOTER.  

ALL VENDORS MUST HAVE GENERAL LIABILITY INSURANCE AND A CERTIFICATE OR SIGN AND RETURN  THE ATTACHED WAIVER EMAILED TO RSTEVENSON@SHORESMOKESEASONINGS.COM BEFORE THE  SHOW OR YOU WILL NOT BE ALLOWED TO PARTICPATE IN THE SHOW.  

All vendors must keep their product within their assigned marked space. Please make sure all aisles and  walkways are clear and nothing is in them.  

Booth- All table covers must extend to the ground and be presentable. All trash must be placed in the  receptacles around the grounds and any boxes must be taken with you or broken down and placed in the  receptacles.  

Parking- All vendors must move their vehicles off the grounds by 930am and parked in the designated  vendor parking area. Vendor Parking Passes will be given to you on the day of the show in your vendor  packet.  

There is to be no subletting of your booth space.  

You must provide your own tent, table, and chairs.  

Please note this is an outdoor show and electricity is not available.  

ALL food vendors are required to co contact the local health dept for a permit at (302) 856-5355

DELAWARE SEAFOOD FESTIVAL WAIVER  

The LICENSEE signed below agrees to the additional terms and conditions and is therefore incorporated  therein by reference:  

1. Licensee has been granted the right and privilege to use space provided by The Delaware Seafood  Festival at American Legion Post 28 in Millsboro Delaware and in consideration of this right and privilege  and other good and valuable consideration it is hereby agreed:  
2. Licensee hereby covenants and agrees to fully release, exonerate, indemnify, defend and hold  harmless The Delaware Seafood Festival, Shore Smoke Seasonings, American Legion Post 28 its officers,  directors, employees, volunteers and agents, from and against any and all claims, suits, proceedings,  actions, causes of action, responsibility, losses, damages, fines, penalties, liabilities, payments,  judgments, demands and expenses (including reasonable attorney’s fees) for any injury or death to  persons (whether they be third parties, the parties to this agreement, their employees, agents,  volunteers or otherwise) or for damage to property (whether it be that of the Licensee, Delaware  Seafood Festival, Shore Smoke Seasonings, The American Legion Post 28 or a third party) caused by,  growing out of, or arising from the negligence committed by the Licensee during the term of this  agreement. In further consideration, Licensee hereby agrees to assume all liability, jointly and severally,  for any injuries to persons or damage to property that may be performance related, or that Licensee or  its employees, contractors or performers may cause to any person or property during Licensee’s use of  and visit to the fairgrounds while Licensee is engaged in any activities supporting the Delaware Seafood  Festival. 
3. The Delaware Seafood Festival, Shore Smoke Seasonings or the American Legion Post 28 shall not be  liable for any damage or injuries of the Licensee(s), their contractors or their equipment, while on the  Festivals premises, and Licensee hereby releases The Delaware Seafood Festival, Shore Smoke  Seasonings or the American Legion Post 28 its officers, directors, staff, employees, representatives and  agents from all form and manner of risks inherent or relating to such activities, and agrees to waive all  claims and demands of any nature arising from said presence on the fairgrounds, commercial activity,  performance or related activities, except for those losses or claims arising solely from the gross  negligence or willful misconduct of The Delaware Seafood Festival, Shore Smoke Seasonings or the  American Legion Post 28. 
4. Licensee shall defend any actions, suits, and proceedings, which may be brought against The  Delaware Seafood Festival, Shore Smoke Seasonings or the American Legion Post 28 with respect to the  foregoing or in The Delaware Seafood Festival, Shore Smoke Seasonings or the American Legion Post 28  may be impleaded, using legal counsel acceptable The Delaware Seafood Festival, Shore Smoke  Seasonings or the American Legion Post 28, and shall pay, satisfy, and discharge any judgments, orders,  and decrees which may be recovered against The Delaware Seafood Festival, Shore Smoke Seasonings or  the American Legion Post 28.
5. Licensee assumes all risk and liability arising from or in connection with its participation and other  activities while on the fairgrounds and assumes and shall bear all risk of loss or damage to, or theft or  destruction of, Licensee’s equipment and personal property while on the premises. 
6. The laws of the State of Delaware shall govern the validity and interpretation of this waiver. The laws  of the State of Delaware shall govern all rights, obligations, remedies, and liabilities arising pursuant to  this contract and any rider(s) attached thereto for any legal action relating to this contract shall be  Sussex County, Delaware. 
7. Licensee shall not discriminate in any manner against any guest, patron, employee or volunteer  because of race, sex, age, color, physical or mental handicap, marital status, religion, national origin, or  political affiliation. 

IN WITNESS WHEREOF, the Licensee hereby agrees to accept the foregoing terms and conditions of this  waiver on the date shown herein. 

By signing this form, you are indicating that you are aware that you and your vendor space (including  workers) take full responsibility for your area and time at the Delaware Seafood Festival. The Delaware  Seafood Festival, Shore Smoke Seasonings or the American Legion Post 28 are not responsible or liable  for anything. The Delaware Seafood Festival, Shore Smoke Seasonings, and the American Legion Post 28  all highly recommend that you carry insurance for the event, and this serves as notice of that  recommendation. By signing this you are waving any liability for anything hazardous that happens at The  Delaware Seafood Festival as well as The Delaware Seafood Festival, Shore Smoke Seasonings or the  American Legion Post 28 will not be held liable. By signing this form, you understand and wish to move  forward in being a vendor at the Delaware Seafood Festival.
